Canonical marriage process

Level of the course: Advanced

Objectives of the course:

to introduce into a formal course of four specific processes: a case of annulment of a marriage; the case of separation of spouses; the process of dispensation from the contracted marriage and not consummated; and the process concerning the presumptive death of a spouse

Prerequisites:

a) knowledge of court action in general (KPK can. 1400 to 1500; KKKW can. 1007 - 1184,

b) knowledge of rules and the course of the process in question (KPK can. 1501 to 1655; KKKW can. 1185-1356

Course contents:

Introduction to the standards governing the processes of marriage (KPK can. 1671-1716; KKKW can. 1357-1400) and with the dispositions of Instruction Dignitas conuubii

5.1. The introductory libellus of the cause

5.2. The citation and the communication of judicial acts

5.3. The formulation of the doubt

5.4. Parties who do not appear

6. The ending of the instance

6.1. The suspension, abatement and renunciation of the instance

6.2. The suspension of the cause in case of a daubt about non-consumation

7. Proofs

7.1. The judicial examination

7.2. Specific proofs

8. Incidental causes

9. The publication of the acts, the conclusion in the cause and the discussion of the cause

10. The pronouncements of the judge

11. The transmission of the cause to the tribunal of appeal and its processing

12. The challange of the sentence

12.3. A petition for a new examination of the same cause after two conforming decisions
