Short description:

Basic, yet needs basic knowledge of the history of the Church and the Roman law

Presenting students with the beginnings of canon law, its formation and development in the pre-Gratian era, through the period of classic canon law, the Council of Trent resolutions and their reception and meaning for the life of the Church and development of canon law, though the Corpus Iuris Canonici and the period of post-Trent law and then presenting the church legislation included in the 1917 Code of Canon Law and analysis of the canon law period after the II Vatican Council and the influence of council resolutions upon the shape of canon law norms in the 1983 Code of Canon Law. Another objective of the lecture shall be to present students with the history of canon law institutes (particular norms) in the period of twenty centuries of the Church history.

The student should have basic knowledge of the history of the Church and the Roman law.

Full description:

The substantial contents of the lecture shall include the following issues: 1. Pre-Gratian period of canon law (ius ventum) – beginnings of canon law from establishing of the Church until Emperor Constantine; 2. Canon law under influence of Roman and Byzantine emperors and the impact of the Roman law upon Church law; 3. Canon law under the influence of German peoples from 7th till 12th century; 4. The era of classic canon law – ius novum; 5. The period of post-Trent canon law – ius novissimum (the Council of Trent resolutions and their impact upon the shape of canon law norms and their perception and meaning for the life of the Church and other canon law institutions, Corpus Iuris Canonici, the 1917 Canon Law Code and its meaning for the Church and canon law); 6. The period of canon law after the II Vatican Council (Vaticanum II resolutions, their impact on the new law, the influence of the council aggitnamento upon codification works, the 1983 Canon Law Code, its shape and various institutions of canon law).

Efekty kształcenia i opis ECTS:

Presenting students with the beginnings of canon law, its formation and development in the pre-Gratian era, through the period of classic canon law, the Council of Trent resolutions and their reception and meaning for the life of the Church and development of canon law, though the Corpus Iuris Canonici and the period of post-Trent law and then presenting the church legislation included in the 1917 Code of Canon Law and analysis of the canon law period after the II Vatican Council and the influence of council resolutions upon the shape of canon law norms in the 1983 Code of Canon Law. Another objective of the lecture shall be to present students with the history of canon law institutes (particular norms) in the period of twenty centuries of the Church history. This shall be a presentation of the history of the canon law institutions, their beginnings, development and changes of legal norms throughout the history of the Church and showing the entire law system from the development and evolution perspective.
