Short description:

The lecture will show the norms and contents of the code and canon analysis. 1098 KPK talking about deceitful misrepresentation as a defect of marriage agreement and nullity of marriage. It will approximate the character of the person caused by the deception, showing what is the deceitful action taken to get married consent. Analysis of this legal norm contained in can. The 1098 NCP will clarify three elements: the deceitful act itself (and the corresponding deception by the victim of such action), the purpose of the action and its object

Full description:

The lecture will cover the presentation of can. 1098 KPK and its analysis. This standard speaks of deceitful misrepresentation as a defect of conjugal consent and the title of nullity of marriage. The lecture will give an approximation of the character of the person caused by the deceit, showing what is the deceitful action of the contracting party contracting marriage to get married consent. Analysis of this legal norm contained in can. The 1098 NCP will include a detailed explanation of the three elements: the deceitful act itself (and the corresponding deception by the victim of such action), the purpose of the action and its object. This issue will also cover issues of retroactivity. 1098 KPK.

EK - 3 - student will use theoretical knowledge to describe and analyze legal processes and phenomena and formulate their own opinions;

EK - 4 - student can use the acquired knowledge to solve problems arising in pastoral work, administration and judiciary and assess the effectiveness and usefulness of applied knowledge;

EK - 5 - student has the ability to understand and analyze legal phenomena, broadened their ability to underestimate the theoretical background of matrimonial law by applying appropriate research methods;

competence:

EK - 6 - the student sees and discusses new problems in canon and is able to discuss them and formulate proposals for solving them;

Ek - 7 - student is aware of the importance of behaving in a professional and ethical manner, adhering to the ethics of the legal profession, broadened his ability to actively promote such attitudes;

EK - 8 - a student is able to work in a group and work in a group, taking on a variety of roles in the Church's tasks.

Practical placement:

The lectures will discuss some of the judgments of the Roman Rota Court on matrimonial matters relating to misleading.
