Level of the course: basic

Objectives of the course:

Introduction to the history of monuments of canon law and literature on canon law over twenty centuries of the Church and their analysis in terms of legal and historical aspects.

To demonstrate the sources and literature of canon law from the very beginning of the Church history until the present Code of Canon Law.

Course contents:

TOPICS of classes:

1 The concept and division of the sources of ecclesiastical law. The Holy Scripture. Tradition; files of popes, etc.

2 Pseudo-apostolic collections; collections of Catholic regional unity; collections of the national and regional differentiation; collections of the Byzantine Church; systematic collections.

3 Western collections; collections of the Insular Church (Ireland and Britain); collections of Gallia.

4 Collections of the authentic and counterfeit Carolingian reform.

5 Decrees of Pseudo Isidore and their influence on ecclesiastical law.

6 The systematic collection of ecclesiastical laws before the Gratian Decree of 1140.

7 Collections preceding the Gregorian reform; collections of the developed Gregorian reform.

8 Writings and collections preparing the Gratian Decree.

9 The Decree of Gratian.

10 Collections created after the Decree of Gratian till the Decrees of Gregory IX, etc.

11 Corpus Iuris Canonici.

12 Collections created before the Code of Canon Law in 1917. Collections of Synods.

13 Collections of files of popes. Collections of the Roman Curia files.

14 History of the Code of Canon Law in 1917. Collections created after 1917.

15 The Code of Canon Law of 1983, and the history of its creation.

16 Legislative collections created after 1983, i.e. after the promulgation of the Code of Canon Law in 1983

Assessment methods:

CONDITIONS of receiving credit of the course:

exam and attendance at lectures;

FORMS of receiving credit of classes:

oral exam;

CRITERIA of credit:

positive knowledge, activity at lectures

Knowledge:

They know basic terms and have extended knowledge about sources of canon law and literature of canon law. They understand subject and methodolical specificities of canon law. They have knowledge about historical factors of the formation of canon law discipline. They have systematized knowledge in the area of ecclesiology and biblical theology. They have knowledge about the role of Magisterium of the Church. They have thorough knowledge of practical methods of law texts analisys.

Abilities:

They are able to use correct theological concepts, especially from biblical theology and ecclosiology. They are able to acquire on their own research skills in the area of theology and literature of canon law. On the basis of literature they are able to raise and analyse research problems in the area of sources of canon law. On the basis of sources they can point theological basics of dispositions of canon law. They are able to understand and analyse legal norms using adequate methods.

Competences:

They are aware of the range of knowledge they have and understand the need of its broadening and extanding. They recognize new problems, formulate them and find solutions for them. They can share possessed knowledge with others, justifying their thoughts. They are aware of the role of the tradition and heritage in canonical teaching and life of the Church.
