The course aims to shape the theological formation of students of canon law.

Prerequisites:

The student must have prior knowledge of ecclesiology to the extent provided in the first cycle of ecclesiastical studies.

Course contents:

TOPICS OF CLASSES:

1. Theology ofthe Church law as a scientific discipline (theological, canonical). The origins of the theology of law. The thesis of Rudolf Sohm.

2 Bases of the Church law (methodological issues: a) legal, b) theological, ecclesial roots of the Church law.)

3 The concept of canon law (the Church law experience, the parameters of the concept of the ecclesiastical law)

4 Law of God in the Church law (the notion of God's law, the promulgation of the law of God, immutability of God's law, dispensation of God's law, the legal nature of God's law).

5 Binding power of ecclesiastical law (the scope of ecclesiastical law, the concept of the Church discipline, canonical norms and freedom of the act of faith, obedience to the law, the correction norms).

6. Theology of ecclesiastical law

7. Ecclesiastical law and secular law (the "history utriusque iuris" the law of "perfect communities", the analogy of law.

8. Canonistics (historical outline, methods, canonistics and other sciences).

EFEKTY KSZTAŁCENIA

WIEDZA:

EK 1 - student ma pogłębioną wiedzę o aksjologicznej, szczególnie etycznej istocie prawa oraz o teologicznej naturze prawa kanonicznego, a także o znaczeniu prawa dla poszczególnych osób, społeczeństwa, państwa i Kościoła.

EK 2 - student ma pogłębioną wiedzę o historycznym procesie kształtowania się prawa kościelnego i jego interpretacji, różnicy pomiędzy prawem kościelnym i państwowym; motywach przestrzegania prawa kościelnego i jego mocy wiążącej.

przygotowanie do ćwiczeń - 15 godz.

przygotowanie do kolokwium i egzaminu - 45 godz.
