The aim of the course is to acquaint students with the subject of anti-discrimination law with a particular focus on the area of employment

Full description:

The aim of the course is to acquaint students with the subject of anti-discrimination law with a particular focus on the area of ​​employment. We will discuss the following issues

1. Introduction to discrimination

2. Definition of discrimination

3. Areas of protection against discrimination, protection against discrimination, diversity of standards of protection against discrimination.

4. Prohibition of discrimination on grounds of sex

5. Prohibition of discrimination on grounds of nationality [the concept of EU citizenship, a few words on secondary legislation - the free movement of persons / workers, case law of the ECJ]

6. Prohibition of discrimination on grounds of race and ethnicity [Council Directive of 29 June 2000 on the application of the principle of equal treatment between persons irrespective of racial or ethnic origin (2000/43 / EC), the case law of the ECJ]

7. The prohibition of discrimination on other grounds of discrimination [Council Directive of 27 November 2000. Establishing a general framework for equal treatment in employment and occupation (2000/78 / EC), the case law of the ECJ]

8. Implementation of EU anti-discrimination directives into Polish law

9. Prohibition of discrimination on the basis of the European Convention on Human Rights and other documents of international law.

Efekty kształcenia i opis ECTS:

EK1 has expanded knowledge on issues of anti-discrimination law

EK2 is able to interpret and apply in practice labor legislation prohibiting discrimination on the problems with using the rules of logical reasoning

EK3 is able to use electronic legal databases to further self-study, including follow closely the changes in the anti-discrimination legislation and learning the doctrines and court decisions

EK4 has the ability to apply theoretical knowledge on the issues of anti-discrimination law to describe, analyze and resolve specific legal issues

Assessment methods and assessment criteria:

The assessment will depend on the result obtained by the student for the final exam in the form of a multiple choice test. The test will consist of no less than 30 questions in the subjects discussed at the lecture, and in the primary literature (this includes in-law of basic legal acts). Questions will be arranged so as to be able to verify the level of achievement by the student benchmarks learning outcomes. Th following rating scale will apply, depending on the number of correct answers :

above 90% to 100% 5.0;

above 80% to 90% 4,5;

above 70% to 80% 4,0;

more than 60% to 70% 3,5;

greater than 50% to 60% 3.0

50% or less 2.0
