Short description:

The aim of te course is to provide an understanding of the general principles of international commercial arbitration, the process and procedure. Detailed topics to be covered:

1. Introduction: mechanism, origin, civil society manifestation, features, uniformisation at international level- NY Convention and Uncitral Model law, arbitration institutions;

2. Arbitration Agreement: form and its evolution, content, possible variants and mistakes;

3. Arbitrators: independence and impartiality, IBA Guidelines, appointment and dismissal;

4. Arbitrability; general rules, corporate disputes, employment disputes, torts;

5. Arbitral procedure: competenz- competenz, mechanisms securing predictability and flexibility, confidentiality, interim measures,

6. Setting aside arbitral awards: procedures and cases;

7. The quiet Triumph – SCC movie show and discussion.
