  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;
  • the student’s weekly hourly workload is 45 h;
  • 1 ECTS point corresponds to 25-30 hours of student work needed to achieve the assumed learning outcomes;
  • weekly student workload necessary to achieve the assumed learning outcomes allows to obtain 1.5 ECTS;
  • work required to pass the course, which has been assigned 3 ECTS, constitutes 10% of the semester student load.

Celem wykładu jest zapoznanie studentów z polskim modelem postępowania w sprawach nieletnich, ukształtowanym w ustawie o postępowaniu w sprawach nieletnich z 1982 r., oraz ustawie o wspieraniu i resocjalizacji nieletnich z 9 czerwca 2022 r. na tle innych europejskich modeli, z szerokim wykorzystaniem orzecznictwa oraz wyników badań empirycznych (aktowych).

Wykład obejmuje następujące podstawowe zagadnienia merytoryczne:

1. Aspekt historyczny, w tym geneza i ewolucja ustawy o postępowaniu w sprawach nieletnich oraz ustawy o wspieraniu i resocjalizacji nieletnich.

2. Współczesne modele (systemy) prawne regulacji problemu przestępczości nieletnich.

3. Kontekst międzynarodowy odpowiedzialności nieletnich w świetle standardów minimum ONZ dotyczących wymiaru sprawiedliwości wobec nieletnich (Reguły Pekińskie).

4. Podstawowe pojęcia i dyrektywy ustawy: nieletni, demoralizacja, dobro nieletniego, zasada indywidualizacji.

5. Mediacja w sprawach nieletnich - geneza, stan prawny, praktyka.

6. Przejawy demoralizacji - aspekt teoretyczny i praktyka sądowa.

7. Środki przeciwdziałania demoralizacji w świetle ustawy o wspieraniu i resocjalizacji nieletnich (środki wychowawcze, lecznicze i poprawcze).

8. Karna odpowiedzialność nieletnich.

9. Postępowanie w sprawach nieletnich - aspekt proceduralny obowiązujących regulacji, podstawowe zasady.

10. Postępowanie rozpoznawcze w sprawach nieletnich- model normatywny.

11. Postępowanie wykonawcze ze szczególnym uwzględnieniem wykonywania środków wychowawczych.

Student:

- has in-depth knowledge of the causes and consequences of juvenile delinquency, identifies the legal rules governing the matter

- can analyze the legal provisions relating to juvenile delinquency, including the comparative aspects

- is aware of the need for further improving the knowledge and ethical and professional standards

- understands the need to cooperate in the creation, application and testing of family law in the framework of the interdisciplinary team
