Learning outcomes:

SM1_W11: the student knows and understands the norms and rules of international law, EU law and international disputes and conflicts. He/she has knowledge of their sources, nature, changes and methods of operation.

Description of ECTS

Participation in the lecture: 30 h

Own work with the literature on the subject and source materials: 15 h

Preparation for the exam: 25 h

Total time: 100 h

ECTS: 100 h / 25 = 4 ECTS

Assessment methods and assessment criteria:

Assessment methods: the basis for admission to the exam is passing the exercises. The exam takes place after the lectures, in the oral form. The student will receive 3 questions.

SM1_W11: the student knows and understands the norms and rules of international law, EU law and international disputes and conflicts. Has knowledge of their sources, nature, changes and methods of operation.

Mark 2 The student does not know and understand the system and method of operation of public authorities in Poland and cannot define their competences as well as mutual relations between them, also in terms of the protection of human rights, in the dimension specified by constitutional and administrative law and related subjects,

Grade 3 The student only partially knows and understands the system and method of operation of public authorities in Poland and is only partially able to define their competences as well as mutual relations between them, also in the aspect of human rights protection, in the dimension specified by constitutional and administrative law and related subjects ,

Mark 4 The student well knows and understands the system and method of operation of public authorities in Poland and is well able to define their competences as well as mutual relations between them, also in the aspect of human rights protection, in the dimension defined by constitutional and administrative law and related subjects,

1. Evolution of the integration process (institutional, material and territorial);

2. Legal personality of EU;

3. EU institutional system: institutions (European Council, Council, European Commission, European Parliament, CJEU, Court of Auditors, European Central Bank), subsidiary bodies (Economic and Social Committee, Committee of the Regions), EU agencies; national authorities as dual capacity;

4. the scope of application of EU law; Member States and the EU (the principle of sincere cooperation, the transfer of state competences as the basis of EU law, the obligation to ensure the effectiveness of EU law in national law, state liability for violation of EU law);

5. Axiology of the EU;

6. Sources of EU law: primary law, general principles of law, international law binding the EU, derivative law;

7. EU law and national law (principle of primacy of EU law, principle of direct effect, direct applicability and application of EU law);

8. creating EU law (creating primary law, concluding international agreements with third parties, enacting derivative law); integration methods (unification, harmonization, coordination);

9. implementation of EU law in general;

10. control of compliance with EU law: judicial (an action for breach of EU law, an action for annulment, a complaint for failure to act in law, a complaint under Article 269 TFEU, an action for damages); general provisions on court proceedings; extrajudicial (petitions to the EP, European Ombudsman);

11. The interpretation of EU law; cooperation of national courts with the CJEU in the preliminary ruling procedure;

12. An individual in the EU: EU citizenship, protection of fundamental rights;

Teaching methods:

In the summer semester of the 2021/2022 academic year, classes are conducted in a direct form, with possible use - in the event of worsening of the epidemic situation - synchronous contact (using the MS Teams tool) with the support of asynchronous contact (using the Moodle Platform).

I. Teaching methods:

1. lecture or (if the epidemic situation does not allow direct form of classes) - videoconference via the MS TEams;

2. multimedia presentation posted for students on the Moodle platform;
