  • the annual hourly workload of the student’s work required to achieve the expected learning outcomes for a given stage is 1500-1800h, corresponding to 60 ECTS;

Short description:

The main objective of the subject is to present the accessibility of justice in Poland - in relation to the assumptions arising from Goal 16 of the SDGs.

Full description:

The range of activities undertaken under SGDs Objective 16: Promote a peaceful and inclusive society, ensure access to justice for all, and build inclusive, effective and accountable institutions at all levels is very broad. One such task included in the 2030 Agenda for Sustainable Development is Promoting the rule of law at national and international levels and ensuring equal access to justice for all (16.3) and Developing effective, accountable and transparent institutions at all levels (16.6).

The topic of the class will concern the presentation of the legal framework shaping the accessibility of justice in Polish law. Particular attention will be paid to the presentation of the constitutional basis for the right to court (Article 45 of the Constitution) and the prohibition on closing the judicial route (Article 77(2) of the Constitution).

The class will discuss basic issues concerning the formation of access to a common court in civil cases . The class will address the subject of accessibility to court in administrative cases. Attention will be paid to the role played by the administrative judiciary in relation to the control of public administration activities.

1. has the terminology to describe the system of law and the purpose of the 16 SDGs, in particular in relation to the justice system in Poland

2. has knowledge to reproduce the assumptions of accessibility to justice

3. has knowledge of the principles of access to common courts and administrative court

B. Skills

4. interprets legal acts and on their basis draws correct conclusions (identifies, searches for legal acts and interprets the provisions correctly)

5. is able to identify individual solutions forming the right to court

C. Competences

6. is aware of the importance of the accessibility of justice for the formation of civil society and a democratic state of law

7. is able to work individually, showing initiative and autonomy in actions, and to cooperate effectively in teamwork, performing various roles in it.
